Consumer defense, also known as consumer protection or consumer rights, is an area of law that gives individuals the ability to combat abusive practices by businesses and organizations. Consumer defense attorneys help clients by protecting them from businesses and sellers of goods and services that are relying on unfair, fraudulent, or abusive conduct that has been deemed unlawful.

Below, we will take a look at some examples of how consumer defense attorneys can help you, and the different areas of consumer defense that you should know about.

Areas of Consumer Defense

To know how a consumer defense attorney might help you, let’s look at some of the most common areas of the law that they work with. There are three primary acts that protect consumers from business and sellers of goods and services, they are as follows:

FDCPA: The Fair Debt Collection Practices Act is a federal law written to limit third-party debt collectors who are collecting debts on behalf of others. It limits how they contact debtors, as well as what time of the day and how often they can contact them. For instance, if a debt collector is calling several times after 9pm, they would be in direct violation of the FDCPA.

TCPA: The Telephone Consumer Protection Act, which limits the means of telemarketing, phone calls, text messages for business purposes, as well as restricting automatic dialing systems, artificial and prerecorded voice messages. For instance, a business making robocalls to a phone number without written consumer consent is against the TCPA.

FCRA: The Fair Credit Reporting Act places restrictions and regulations on how organizations can collect an individual’s credit information or access their credit reports. It offers consumers the right to access their own reports for free, for instance, while stopping businesses from performing “hard checks” without the consent of the consumer.

A consumer defense lawyer can help in all these areas. If you believe that debt collectors, telemarketers, or businesses that access your credit reports are doing it unfairly or unjustly, the
law may support your case. A consumer defense lawyer can help you find out an advocate for you.
